Nominal Damages

"To obtain nominal damages, a plaintiff must show at least some form of loss. False: It’s impossible to avoid all ambiguity here, but nominal damages are awarded for some causes of action, like trespass to land, even in the absence of any loss. While it’s possible to construe “loss” so broadly as to include bare violation of a legal right, I don’t think that’s the most reasonable construction."
