"Mr. Colden, for the defendant, admitted that pursuit alone does not ordinarily give a right of property in animals ferae naturae and that occupancy is necessary to establish title. He argued, however, that occupancy is not limited to manucaption, or actual bodily seizure. Relying on Puffendorf and Barbeyrac, he contended that any continued act showing an intention to appropriate a wild animal may be equivalent to occupancy. Pursuit by a person who starts a wild animal gives an exclusive right while the animal is followed, because it is the possession that the nature of the subject permits and declares the pursuer’s intention to acquire dominion."
