Walby v. Canada, 2025 FCA 94 | Tax Interpretations / B. Meaning of the Word “Gift”

"The appellants argue that the cash payments were valid gifts because they did not actually receive anything of value as a result of making these payments. This argument raises the question — what is the meaning of the word “gift”? The word “gift” is not defined in the Act. The appellants rely on the decision of the Tax Court in Morrison v. The Queen, 2018 TCC 220 (Morrison). Although Morrison was appealed to this Court, the issue of whether Mr. Morrison was entitled to a charitable donation tax credit based on the cash payment that he had made was not before this Court in that appeal."
